Article 1 - Definitions

Travel Planner”, ‘Eye For You’, ‘Company’ – refers to the sole proprietorship Eye for You – Jade BESSE.

“Consumer” – refers to any natural person, not acting in the course of a commercial, industrial, artisanal, liberal or agricultural activity, who subscribes to a service offered by Eye for You.

“Services” – means all Services offered by Eye For You.

“Deliverables” – refers to the document sent to the Consumer in the first instance, presenting the Consumer with the various choices of service providers with booking links to each of them.

“Travel Book” – refers to the final document containing the Consumer’s reservations, if desired, as well as suggested itineraries, visits, practical information and other information relating to the requested trip.

Article 2 - About Eye For You

Eye for You is a one-man business offering Travel Planner services.

Eye for You’s objective as a Travel Planner is to advise and propose an organization in line with the Consumer’s planned trip.

The Services offered by Eye for You do not include booking, which is the responsibility and at the discretion of the Consumer.

Article 3 - Object

The present General Terms and Conditions of Sale & Services apply to all sales of services made by Eye for You. They govern the relationship between the Consumer and the Company in the context of the provision of its Services.

When the Consumer accepts the quotation, he/she is asked to read and sign these GTS.

Proof of acceptance of the GTS is stored in accordance with the Privacy Policy.

Upon acceptance, a copy of the GCS is sent to the Consumer on a durable medium (e.g. PDF). The General Terms and Conditions of Sale are available at any time on request from Eye for You.

Article 4 - Contractual documents

The contractual relationship between the Consumer and the Company consists of the following contractual documents, presented in hierarchical order of decreasing legal value:

– These General Terms and Conditions,

– The signed quotation,

– Invoice.

In the event of contradiction between the documents, the higher-ranking document shall prevail. These documents comprise the entirety of the obligations between the Consumer and the Company, and any other document shall not prevail.

Article 5 - Access to services

Access to the Services offered by Eye for You is reserved to natural persons legally capable of entering into a contract.

The Consumer may request a quote from Eye for You by completing the online form on eyeforyou-trips.com or by sending a request by email to hello@eyeforyou-trips.com or private message via Instagram on the account of @eyeforyou.trips .

Access to the Services by the Consumer is subject to acknowledgement and acceptance of these GTC.

Article 6 - Order

First written exchanges. Before subscribing to a Service, the Consumer presents his travel project to Eye for You by email.

Quotation. Following these written exchanges by email, Eye for You sends a quote to the Consumer. The Consumer has 30 days from receipt to validate the order by signing the quote.

Acceptance of terms and conditions. After validating the quotation, the Consumer is invited to read and accept these GTC. The service cannot begin without the Consumer’s acceptance.

Electronic signature. The Consumer may sign by hand or electronically. Both types of signature will constitute the Consumer’s acknowledgement and acceptance of the GTCS.

Payment. Payment is made by credit card via the Stripe secure online payment platform.

Order confirmation. In order to notify the Consumer of the successful receipt of his/her order, Eye for You will send him/her by email a summary of his/her order as well as the applicable GTC.

Proof of transaction. In order to provide proof of the Consumer’s entire order, Eye for You retains, under reasonable security conditions, proof of communications, order form, signature, transaction and invoice.

Article 7 - Service features

Eye for You’s Services are presented to the Consumer via the eyeforyou-trips.com website as well as on the Company’s networks. The Consumer may contact the Company for further information on any of the Services.

Please note Prices and Services offered by Eye for You do not include booking (hotels, flights, reservations, etc.). Booking fees are the responsibility of the Consumer and are not included in the Services. The Travel Planner provides advice and research only. The Consumer is free to book or not to book in the establishments and organizations recommended by Eye for You.

Furthermore, the Consumer is warned that the content of the Deliverables is provided by the Travel Planner for information purposes only, and the Consumer is therefore invited to check the information for him/herself when preparing his/her trip.

Independence. Eye for You has no contractual or financial ties with the recommended organizations.

Language. All content is in English or French.

Territoriality. The Services offered by Eye for You are available for sale internationally.

Evolution. The Consumer subscribes to the Services available at the time of ordering.

Article 8 - Price

Prices for Services are communicated by quotation upon request to Voyage Kiwi.

Prices are indicated in euros and are exempt from VAT.

In the event of a price change, the Consumer remains subject to the price indicated at the time of validation of the quote.

Any request for an additional service made after the order has been issued will give rise to a new estimate and a new deadline for the service, which will be communicated to the Consumer.

Promotional offers and personal discounts may be applied to prices from time to time, in accordance with current legislation.

Prices and the Service do not include booking fees, which are at the Consumer’s expense and discretion.

Article 9 - Duration

After acceptance of the quote and the T&Cs, the Travel Planner sends the Deliverable with the booking links for each proposed service provider to the Consumer on the e-mail address provided when the order was placed, within the timeframe agreed when the quote was drawn up.

The Consumer may make up to 2 modifications at no extra cost within 15 days of receiving the order.

Any request for an additional service made after receipt of the order will give rise to a new quotation and a new deadline for completion of the service, which will be communicated to the Consumer.

Article 10 - Delivery

Digital deliveries. Eye for You communicates to the Consumer all the advice and research carried out by sending a Deliverable via a link available online (Google Drive type) or by digital PDF sent by e-mail.

Article 11 - Right of withdrawal and guarantees

Non-application of the right of withdrawal. In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to the present contract between the Consumer and Eye for You.

Article 12 - Obligations

The Travel Planner undertakes to:

  • Carry out research and provide advice in line with the Consumer’s travel requirements;
  • To advise each service provider according to the needs and desires of each customer, without taking any commission on his behalf;
  • To use the Consumer’s information solely for the execution of the service and the management of the resulting relationship;
  • To keep confidential and not divulge any information provided by the Consumer;

Correlatively, the Consumer undertakes to :

  • Pay the sum indicated on the quotation;
  • Pay the sum within the time limit specified in the quote;
  • Collaborate with Eye for You in order to provide all the elements necessary for the realization of the service;
  • Make reservations as soon as possible after receiving advice and research from the Travel Planner in order to benefit from the recommended offers;

The Consumer is warned that failure to comply with any of these obligations may have consequences for the provision of the Service.

Article 13 - Responsability

Eye for You makes every effort to meet the expectations of its Consumers in accordance with the Services ordered. However, the Travel Planner only provides advice and is not subject to the obligations of a travel agent as regulated by article L211-1 of the French Tourism Code. It is therefore not bound by any obligation of result, and cannot be held liable in the event of events for which it is not responsible, in particular in the event of :

  • Failure to book the proposed transport and/or accommodation for a reason beyond the Company’s control.
  • Erroneous information. The Consumer must fill in the correct information and check the accuracy of his data beforehand (preferences concerning flight conditions, travel dates, information on accommodation or other services, etc.).
  • The poor progress of a holiday, the weather, flight or train cancellations, a bad experience with travel, accommodation or any other service. Booking a trip is the sole responsibility of the Consumer.
  • Price increases for proposed bookings (accommodation, transport, restaurants, activities, etc.).

The content of the Deliverables provided to the Consumer is provided by the Travel Planner for information purposes only, and the Consumer is therefore invited to check the information for him/herself when preparing his/her trip.

Eye for You may only be held liable for direct and certain damages for which it is responsible.

Article 14 - Intellectual property

Eye for You declares that it is the owner of the Content communicated to the Consumer, namely: the domain name, logo, documents, graphics, videos, texts, images, photos, knowledge.

Any use or reproduction, in whole or in part, of the Content by a Consumer is strictly forbidden under penalty of criminal or civil sanctions.

The Content sold to the Consumer is delivered on a strictly personal basis. The Consumer is not authorized to transfer, communicate or share the information contained therein. In the event of infringement of this rule, the Consumer shall be held liable and may be subject to sanctions.

Article 15 - Personal data

In accordance with Law N°78-17 of January 6, 1978 “Informatique et Libertés” and the “Règlement Général sur la Protection des Données” of April 27, 2016, the personal data of Consumers is collected for the purposes of managing the contractual relationship and the performance of Services, but also for purposes of evidence. Consequently, the Consumer has rights relating to this processing: right of access, right of rectification, right to be forgotten, right to limitation, as well as a right to portability.

Eye for You undertakes not to sell, give or rent to third parties the data provided by the Consumer, unless obliged to do so by a legal or regulatory obligation or for a legitimate reason.

Consumers wishing to exercise any of the aforementioned rights must submit a request to the Company, accompanied by proof of identity for security reasons. The request may be made by e-mail to the following address: hello@eyeforyou-trips.com

In particular, the Consumer may lodge a complaint with the CNIL.

For more information about data processing or the application of one of your rights, the Consumer may consult the Privacy Policy applicable to data processing carried out by Eye for You.

Article 16 - Reviews

The Consumer will be invited to give his/her opinion on his/her experience with the Travel Planner. The Consumer is warned that this Opinion may be reused by the Company for communication purposes as well as for advertising or promotional purposes on its Site and its social networks.

Article 17 - Evolution of the Terms and Conditions

Modification of the GTC. Eye for You reserves the right to modify these GTC at any time and without notice in order to adapt them to changes in its business. The Consumer remains subject to the GTC applicable at the time of the Order.

Case of ineffective clause(s). In the event that any clause of these GTS should be temporarily or permanently inapplicable, all other clauses shall remain in full force and effect.

Article 18 - Force majeure

In accordance with article 1218 of the French Civil Code, in the event of force majeure, i.e. any situation beyond the Company’s control which cannot be reasonably foreseen and whose effects cannot be avoided by appropriate measures, performance of obligations will be suspended.

In addition to the cases usually recognized by the Jurisprudence, the notion of force majeure refers in particular to: natural disasters, fires, floods, epidemics/pandemics, blockage of means of transport or supply, stoppage of telecommunication networks, internal and external social conflicts of the company…

Consumers will be informed as soon as possible of the occurrence and duration of suspension in the event of force majeure or foreign cause. Consequently, Eye for You cannot be held liable in the event of a breach of the Company’s obligations or if the Consumer encounters difficulties in accessing or using the Services due to the aforementioned circumstances. Should the suspension of obligations justify the termination of all or part of the contract, full or partial restitution will be made as soon as possible.

Article 19 - Applicable law

These General Terms of Services are governed by French law. They are written in French only. In the event of litigation, no translation into another language may be substituted.

Article 20 - In case of dispute

In the event of a dispute, the Consumer and the Company will work together to find an amicable solution. The Consumer may initiate a request by e-mail to: hello@eyeforyou-trips.com or by post to: 18 Hameau de Courson 02380 LANDRICOURT

Where appropriate, and in accordance with the French Consumer Code, the Consumer may refer the matter to a mediation service.

In the absence of an amicable resolution, the dispute will be submitted to the French courts, subject to any specific jurisdiction conferred by law or regulation.
